SC Orders Not to Allow Unauthorized Access to Personal Info

The Supreme Court (SC) has issued an order directing Nepal Telecom not to allow unauthorized access to personal information.

Releasing the full text of the verdict from the division bench of Justices Dr. Nahakul Subedi and Mahesh Sharma, delivered on September 10, 2024, the SC on Monday emphasized the protection of privacy, personal freedom, and a dignified life as fundamental rights.

The full text states, “Ensure the protection of such fundamental rights even in the procurement and installation of billing systems, as well as ensure that there will be no conflict of interest during the procurement process.”

It was highlighted in the ruling that suppliers of the billing system would have access to information and data on Nepal Telecom customers’ mobile phones, posing risks to sensitive and confidential citizen data.

Nepal Telecom had issued a tender notice on March 31, 2024, to install the ‘CRTB’ system, replacing the existing integrated billing system. Concerns were raised that the installation of the ‘CRTB’ system could lead to breaches of customer privacy, higher costs, and potential financial losses for Nepal Telecom.

Rita Karki, who filed a petition at the SC, argued that the ‘CRTB’ system was not a new solution, was unnecessarily costly, and would compromise customers’ privacy. She also pointed out that its implementation could result in financial losses for Nepal Telecom.

The court’s decision mandates strict measures to safeguard personal information and avoid conflicts of interest during procurement processes.
