SC Wraps Up Hearing on Petition Against Home Minister Lamichhane
The Supreme Court concluded its hearing on Monday regarding the petition seeking the suspension of Deputy Prime Minister and Home Minister Rabi Lamichhane. Justices Manoj Kumar Sharma and Til Prasad Shrestha presided over the proceedings, marking a pivotal moment in Lamichhane’s ongoing legal saga.
The court is now tasked with deciding whether to grant an interim order, dismiss the writ, or request further evidence, a decision that could have significant implications for Lamichhane’s political future.
If an interim order is issued, Home Minister Lamichhane may face immediate challenges, whereas a decision against interim measures could provide him with some relief.
Simultaneously, preparations are underway to progress the case against Lamichhane to a full hearing in the Supreme Court. Justice Shrestha’s bench has already prioritized discussions and ordered the withdrawal of a complaint filed with the Kaski police, signaling the gravity of the situation.
Despite being cleared by the Attorney General’s office, Lamichhane’s position remains contentious. Advocates, led by Anupam Bhattarai, have filed a writ challenging the validity of the Attorney General’s letter, arguing that Lamichhane’s leadership role within the investigating body compromises the impartiality of any investigation into allegations against him.
The writ emphasizes the importance of Lamichhane stepping down from his position as Home Minister to ensure a fair and thorough investigation into the cooperative fraud allegations leveled against him, citing pending complaints with the Kaski Police and inclusion in charge sheets from other districts.
