SC Clears Path for Bindabasini Kansakar’s Swearing-in as HoR Member

The Supreme Court (SC) has cleared the path for the swearing-in of Bindabasini Kansakar as a member of the House of Representatives (HoR).

The SC, during the hearing of a petition filed by Dhaka Kumar Shrestha against his expulsion from the Rastriya Swatantra Party (RSP) on May 8, had instructed the party not to immediately implement the removal of its lawmaker.

However, on Wednesday, a joint bench comprising Justices Kumar Regmi and Nahakul Subedi ordered that the earlier instruction does not need to be continued, as confirmed by SC Spokesperson Bimal Paudel.

This latest order has now paved the way for the swearing-in of Kansakar, which was previously halted due to the previous order.

On April 12, the Rastriya Swatantra Party (RSP) took the decision to remove Dhaka Kumar Shrestha from his position as a lawmaker and party member following the emergence of an audio recording allegedly featuring a conversation between him and businessman Durga Prasai.

Speaker Dev Raj Ghimire has already announced Shrestha’s expulsion notice in the House, while the party has proceeded to nominate Bindabasini Kansakar, a victim of an acid attack, as a member of the House of Representatives (HoR) through the Proportional Representation electoral system in order to replace Shrestha.

During the party’s central committee meeting on April 12, it was concluded that Shrestha should be disciplined in response to the public disclosure of an audio recording wherein he was purportedly demanding a sum of Rs 20 million from Durga Prasai.
