Court Nullifies EC’s Penalty on Four RSP MPs
In a recent development, the Patan High Court has ruled against the Election Commission’s penalty imposed on four Members of Parliament affiliated with the Rastriya Swatantra Party (RSP).
The Election Commission’s decision, made on Shrawan 9, targeted a total of 2,500 lawmakers from the House of Representatives and Provincial Assemblies for their alleged failure to disclose their election expenditure.
Responding to this, lawmakers Sobita Gautam, Shisir Khanal, Bhiraj Bhakta Shrestha, and Ganesh Parajuli took legal action by filing a case at the Patan High Court. They argued that the commission’s decision to fine each of them Rs 15,000 was incorrect and violated constitutional principles.
Following deliberations, the Patan High Court has nullified the Election Commission’s penalty, marking a significant victory for the four RSP MPs. This ruling underscores the importance of legal recourse in upholding democratic principles and protecting lawmakers’ rights.
