Supreme Court Reinstates Suspended Lawmaker Tek Bahadur Gurung
The Supreme Court has lifted the suspension of Nepali Congress lawmaker Tek Bahadur Gurung. The Court’s ruling came after Gurung challenged his suspension through a writ petition.
Gurung, who represents the Nepali Congress in the House of Representatives, was suspended following a corruption charge related to a bribery case. The case, which concerned financial irregularities in the management of a fun park in Kathmandu, led to his automatic suspension under the Prevention of Corruption Act 2059, as mandated by the Parliament Secretariat.
Despite being fined by the Special Court on February 28, 2023, Gurung did not face jail time. His petition to the Supreme Court argued that his suspension contradicted the constitutional provisions, leading to the justices Manoj Kumar Sharma and Binod Sharma issuing a writ that reinstated him.
The Parliament Secretariat has acknowledged the Supreme Court’s decision and is set to implement it soon. With the reinstatement, Gurung will resume receiving all parliamentary benefits, including salary, meeting, and transport allowances.
The decision underscores the judiciary’s role in resolving issues of legislative legality and parliamentary privileges.
