Supreme Court Issues Interim Order Reinstating Dr. Damodar Basaula

In a significant development, the Supreme Court of Nepal has issued an interim order, reinstating Dr. Damodar Basaula, the Executive Director of the Health Insurance Board. Dr. Basaula, who was suspended earlier this month, challenged the court’s decision, leading to the recent development.

The interim order, effective immediately, places a temporary halt to Dr. Basaula’s suspension until the next hearing. This means that Dr. Basaula can resume his duties while the court further examines the case.

Expressing satisfaction with the interim order, Dr. Basaula emphasized that it upholds the principles of due process and fair investigation. In a statement, he said, “I am happy that the court has recognized the need for a proper investigation before taking any drastic action against me. I am hopeful that the truth will prevail in the end, and I will be cleared of any wrongdoing.”

This development comes as a relief to Dr. Basaula’s patients and supporters who criticized the suspension as unjustified. They have consistently maintained that Dr. Basaula is a dedicated and respected professional.

The suspension of Dr. Basaula occurred during a cabinet meeting on October 11, where he was suspended for three months under Section 25(3) of the Health Insurance Act, 2074. The Ministry of Health and Population had sought clarification from Dr. Basaula on September 21 regarding alleged dereliction of duty.

It’s important to note that the interim order does not constitute a final verdict on the case. The Supreme Court will continue to hear arguments from both sides before reaching a final decision on Dr. Basaula’s suspension. The case has garnered public attention, and many will be closely watching as the legal proceedings unfold.
