Gagan Thapa Strongly Objects to Amnesty for Serious Crimes

Gagan Thapa, a prominent leader of the Nepali Congress and Member of Parliament, has raised strong objections to the government’s recommendation for amnesty leading to the President’s pardon for individuals involved in serious crimes through legal loopholes.

Thapa’s criticism came in response to the recent amnesty granted to Yograj Dhakal, known as “Regal” from Banke, who had previously been imprisoned for the murder of Chetan Manandhar.

The decision to grant amnesty to Regal, coinciding with Constitution Day, has sparked widespread public outrage. In a powerful protest, Chetan’s widow, Bharati, has initiated a hunger strike in Maitighar Mandala, demanding Regal’s return to prison.

Addressing the House of Representatives during Thursday’s session, Thapa, who also serves as the General Secretary of the Nepali Congress, stressed the urgent need to put an end to the practice of exploiting legal ambiguities to secure amnesty.

Thapa asserted, “Given that our Constitution and the laws enacted by it are now subject to misinterpretation, the responsibility of crafting effective legislation falls upon us.”

Thapa criticized the amnesty decision, noting that it has faced opposition in various forms, including from the legislative floor, public protests, and even legal challenges. He demanded that the government provide an explanation to the House.

Emphasizing the government’s accountability, Thapa stated, “The government cannot evade responsibility after making such a decision; it must provide an answer for its actions.”

He also expressed concerns about the widespread misuse of amnesty provisions and called for more stringent criteria based on a single law.

Thapa urged fellow parliamentarians to revisit existing laws and incorporate amendments to prevent misinterpretations. He warned that without legislative corrections, further instances of controversial amnesty decisions might arise, emphasizing that this issue warrants continued discussion.

“In this context, the Speaker should compel the government to respond and clarify the legal framework,” he insisted.

Lawmaker Thapa stressed the importance of the state upholding legal rights and not undermining the trust of its citizens by failing to apply the law appropriately. He emphasized that amnesty, as outlined in the law, must adhere to proper procedures.
